Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Driver", or "Rider") and CarKro ("Company", "we", "us", "our"). By downloading, installing, or using the CarKro application or website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using CarKro on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

To use CarKro you must meet the following requirements:

Drivers additionally require: a valid Pakistan driving licence, a roadworthy registered vehicle, and active vehicle insurance.

• You are responsible for maintaining the confidentiality of your account credentials and OTP codes.
• You must not share your account with any other person or permit unauthorised access.
• You agree to provide accurate, complete, and up-to-date information during registration and to keep it current.
• CarKro reserves the right to verify your identity and documents at any time. Failure to provide verification may result in account suspension.
• Each individual may hold only one Driver account and one Rider account. Duplicate accounts may be terminated.
• You must notify CarKro immediately at support@carkro.com if you suspect unauthorised use of your account.

CarKro is a technology platform that facilitates connections between independent drivers and riders. CarKro is not a transportation company and drivers are independent service providers, not employees or agents of CarKro.

CarKro reserves the right to add, modify, or discontinue any service at any time with reasonable notice to users.

• Independent Contractor Status: You operate as an independent contractor. You are not an employee, partner, or agent of CarKro. You are responsible for your own taxes, insurance, and compliance with Pakistani transport regulations.
• Vehicle Standards: Your vehicle must be roadworthy, validly registered, and insured at all times. Vehicles that fail to meet CarKro's minimum vehicle standards may be delisted.
• Document Compliance: You must maintain valid documents (CNIC, driving licence, vehicle registration, insurance). CarKro may suspend your account if documents expire and are not renewed.
• Conduct: You must treat riders respectfully and professionally. Harassment, discrimination, or unsafe driving may result in immediate account termination.
• Fare Negotiation: Fares are negotiated directly between driver and rider within the range suggested by CarKro's algorithm. You may not demand cash payments outside the platform.
• SOS & Safety: You must cooperate fully with CarKro safety investigations and must not tamper with the SOS or emergency reporting features.
• Data Accuracy: You must not manipulate GPS signals, spoof location, or misrepresent your vehicle or route.
• School Rides: If you provide school rides, you must pass an enhanced background check and comply with CarKro's child safety guidelines.

• Accurate Pickup Location: You are responsible for providing correct pickup and drop-off details. Incorrect information may result in cancellation fees.
• Conduct: You must treat drivers respectfully. Threatening, abusive, or discriminatory behaviour is grounds for immediate account suspension.
• No Unauthorised Passengers: The ride is for you and passengers you disclosed at booking. Subcontracting, reselling, or misusing rides is prohibited.
• Waiting Time: Drivers are entitled to a waiting time allowance. Excessive delays may result in additional charges agreed between rider and driver.
• Damage: You are liable for any damage caused to the driver's vehicle during the ride. CarKro may facilitate dispute resolution but is not financially liable for such damage.
• Carpooling: When booking a carpool, you agree to share the vehicle with other riders and to depart at the scheduled time.
• Scheduled Rides: Cancellations of scheduled rides must be made at least 30 minutes before the scheduled pick-up time to avoid a cancellation fee.

CarKro operates on a subscription model for drivers. Riders pay drivers directly for rides — CarKro does not charge riders a platform fee.

• Driver Subscription: Plans are billed monthly or annually. Your subscription begins on the date of payment and renews automatically unless cancelled.
• Accepted Payment Methods: JazzCash, EasyPaisa, NayaPay, SadaPay, and major credit/debit cards via Stripe.
• Pricing: Subscription prices are displayed on the Plans page and may change with 30 days' notice. Existing subscribers will be grandfathered at their current rate until renewal.
• Refunds: Subscription fees are non-refundable except where required by law or at CarKro's sole discretion (e.g., technical failures preventing service access).
• Failed Payments: If a subscription payment fails, your account will be placed in a 7-day grace period. Failure to settle will result in account suspension until payment is received.
• Promo Codes & Campaigns: Discount codes and campaign rewards are subject to their own validity periods and cannot be exchanged for cash.

Excessive cancellation rates by drivers may affect their visibility in ride matching and eligibility for incentive programmes.

The following activities are strictly prohibited on the CarKro platform:

• Providing false, misleading, or fraudulent information at registration or during any ride.
• Using the platform for illegal transportation, smuggling, or any activity prohibited under Pakistani law.
• Attempting to hack, reverse-engineer, or tamper with CarKro's software, APIs, or infrastructure.
• Creating fake reviews, manipulating ratings, or engaging in review fraud.
• Harassment, threats, or discriminatory conduct towards any other user.
• Using automated bots or scripts to generate fake ride requests or location data.
• Soliciting riders or drivers to transact outside the CarKro platform to avoid fees.
• Sharing account credentials or operating multiple accounts for fraudulent purposes.

Violations may result in account suspension, permanent ban, and/or referral to law enforcement authorities.

• SOS Feature: Both drivers and riders have access to an in-app SOS button that alerts CarKro's emergency team and, where applicable, Pakistan emergency services. Misuse of the SOS feature is grounds for account termination.
• Route Deviation: CarKro monitors active rides for significant route deviations. Automated alerts are sent to riders if an unusual deviation is detected.
• Speed Monitoring: Excessive speeding events are recorded and may result in driver behaviour penalties or account review.
• Masked Calling: CarKro provides masked calling to protect user phone numbers. Do not share personal phone numbers via chat or calling features unless you choose to.
• In-App Chat: All chat messages are subject to CarKro's moderation policies. Do not use chat for any prohibited purpose.
• Incident Reporting: All users are encouraged to report safety incidents via the Support section. Reports are investigated within 48 hours.

All content, software, trademarks, logos, trade names, and intellectual property on the CarKro platform are owned by or licensed to CarKro. You are granted a limited, non-exclusive, non-transferable licence to use the CarKro application for personal, non-commercial purposes.

You may not copy, reproduce, distribute, modify, create derivative works from, or commercially exploit any part of CarKro's platform or content without prior written consent.

By submitting reviews, photos, or content to CarKro, you grant us a worldwide, royalty-free, perpetual licence to use, reproduce, and display such content in connection with our services.

• CarKro's total liability for any claim arising from these Terms shall not exceed the subscription fees paid by you in the 3 months preceding the claim.
• CarKro is not liable for: physical injury or property damage during rides; lost, stolen, or damaged property; delays caused by traffic, weather, or force majeure events.
• CarKro does not warrant that the platform will be uninterrupted, error-free, or free from viruses or other harmful components.
• To the maximum extent permitted by Pakistani law, CarKro excludes all implied warranties and conditions.

We encourage users to resolve disputes through CarKro's in-app support system first. Most issues are resolved within 48 hours.

• Step 1 — In-App Support: Submit a support ticket via the CarKro app or website. Our team will investigate and respond within 48 hours.
• Step 2 — Mediation: If the issue is not resolved, either party may request mediation by contacting legal@carkro.com. CarKro will appoint a neutral mediator within 14 days.
• Step 3 — Arbitration: Unresolved disputes shall be submitted to binding arbitration under Pakistani law. The arbitration will be conducted in Lahore, Punjab, Pakistan.
• Class action lawsuits are waived to the extent permitted by applicable law.

Either party may terminate these Terms at any time:

• User-initiated: You may delete your account at any time via the app settings or by contacting support. Deletion removes your active profile but transactional records may be retained per our Privacy Policy.
• CarKro-initiated: We may suspend or permanently terminate your account for breach of these Terms, fraudulent activity, safety violations, or failure to maintain required documents — with or without notice depending on severity.
• Upon termination, your right to use CarKro ceases immediately. Unused subscription days are non-refundable except at CarKro's discretion.
• Sections 11, 12, 13, and 16 survive termination of these Terms.

CarKro may modify these Terms at any time. Material changes will be communicated via in-app notification and email at least 14 days before they take effect. Continued use of CarKro after the effective date constitutes your acceptance of the revised Terms.

If you do not agree to the updated Terms, you must stop using CarKro before the effective date.

These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. The courts of Lahore, Punjab, shall have exclusive jurisdiction over any matter not subject to arbitration under Section 13.

If any provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
